- When you use the givemecredit website you agree to these terms, which are subject to the laws of England and Wales and which do not affect your statutory rights.
- Our free Find Credit service will assist you in finding credit based on your credit score. We assist you by providing facts to you so that you may make a more informed decision. We do not provide financial advice.
- The Manage Credit service will assist you in finding credit based on the contents of your credit report and will assist you in managing credit. Our assistance is given by presenting all the relevant facts to you in an easy-to-understand format so you can find or manage credit in a more informed way. The card protection element of the service will assist you if your cards, passport or driving licence are stolen. It is not an insurance policy of any sort and must not be relied upon as such.
- If you subscribe to the Manage Credit service, to enable us to obtain your credit report, assist you with finding lenders who are matched to your credit rating, and to help report lost and stolen cards on your behalf, you agree to appoint Credit Reporting Agency Limited as your attorney for the specific purposes of
- the exercising of your statutory rights under section 158 of the Consumer Credit Act 1974 and under section 7 of the Data Protection Act 1998 firstly to obtain all information held about you;
- submitting credit applications on your behalf, and
- reporting lost and stolen cards to your card issuers.
- If you subscribe to the Manage Credit service, we will collect payments from your nominated bank account or card account every year on the anniversary of your first payment until you cancel the service. You can cancel at any time by phoning us on 0800 612 7927 Monday to Friday,
between 9am and 5pm and by obtaining a cancellation reference number. We will confirm cancellation by email. To ensure continuity of service, if payment is refused during your subscription, we will attempt to collect payment from the reserve card that you authorise us to debit in such circumstances.
If our further attempts to obtain payment from your cards fail, we shall cancel the service and advise you by email. We will reinstate your service if you subsequently re-subscribe. We may also cancel the service if you have at any time given us false, misleading or incorrect information, acted in any
way that we consider is dishonest, or have breached any of these terms and conditions.
- Subscriptions for the Manage Credit service provide benefits for one calendar year, or part of the year if cancelled during the year. Upon cancellation of
the service by us or by you, access to the Manage Credit service is blocked and no refund is paid for any unused benefit or for any
period of time remaining in the calendar year. This is because your credit report is personalised and is relevant only to you. It is
delivered to us immediately and prepared on an individually personalised basis for you at the time of your order. The supply of
personalised services fall within the exemption to the right to cancel as defined in clause 13 (1) c of The Consumer Protection
(Distance Selling) Regulations 2000. From time to time we may be unable to obtain your credit report, in which case we will refund
your subscription automatically and cancel your service.
- You agree to take all reasonable steps to safeguard your cards, passport and driving licence. If you report lost or stolen cards, we will assist you by contacting the card issuers on your behalf and ask them to stop the cards and to issue replacements as soon as possible. When we refer to 'cards' this includes credit cards, debit cards,
store cards and charge cards, but not prepaid cards, loyalty cards or membership cards. If you report that your UK passport or UK driving licence is lost or stolen, we will also assist you to obtain replacements urgently.
- A part of the Manage Credit service is that we provide credit reports on a simplified basis to make it easier to understand the contents. If you are using our services to check the accuracy of your own file, you acknowledge that a credit report from us is not the same as the file you would receive if you exercise your statutory rights to obtain a copy of your credit file from any credit reference agency at any time upon payment of the statutory fee of £2. Further details about credit files generally can be found in the Information Commissioner's publication 'Credit Explained'. You agree that you will not use any of the information we provide to you including credit scores as the sole basis for any decision you may make.
- Searches we make of credit reference agencies that you pay for as part of the Manage Credit service will leave an enquiry footprint both in our records and at the credit reference agencies we search. These are for your protection so that you may see who has been searching your credit file and when. Such enquiry footprints are not the same as
those recorded by lenders when you apply for credit and do not affect your ability to get credit. Use of our free Find Credit service does not leave a search footprint on your credit files.
- We use credit scoring both in the free Find Credit service and in the Manage Credit service to identify lenders who are most likely to extend credit to you. The way that credit scores are calculated is a commercial secret. We take no responsibility for the accuracy, relevance or otherwise of credit scores. We can't guarantee that a lender will extend credit to you,
as we may not always be aware of all the facts they take into account. You agree that you will not use any of the information we provide to you including credit scores as the sole basis for any decision you may make.
- We continually try to improve the services we offer and may change the contents of credit reports or any other reports, this web site, the suppliers of information and any other aspect of our products and services without notice.
- Unless you opt out, you agree to receive emailings from us for marketing purposes. Using the relevant link which appears on all marketing emails from us, you may opt out of receiving emails at any time. We do not sell or disclose your email address to any third party.
- You agree not to hold us liable for any losses or damages you may incur either directly or indirectly from the use of the services supplied by us. You agree that you will not hold us, our employees, or any of our suppliers liable for any direct or indirect damages, costs, losses or expenses of any nature resulting from the use or misuse of the information delivered by us.
- You agree not to hold any of our suppliers liable for any delay in delivery or if we fail to supply you or if we omit any information for any reason.
- You agree to indemnify and keep indemnified us, our employees and agents and our suppliers against any claim or action made against them for any losses damages costs or other expenses in connection with your use of our services.
- You agree that you will not use the information provided by us in any way that might be detrimental to us or to our suppliers.
- We have installed security devices and follow procedures that are designed to prevent unlawful access to information. To protect this information we may have to temporarily suspend access to our services from time to time. We may terminate supply of information to you at any time and without notice for any reason that we will not disclose or discuss.
- You agree that you will not disclose your password to any one at any time. You agree that you will not distribute or make available any information supplied by us to any third party. In case of any unauthorised use of our services, you agree to inform us immediately in order that steps may be taken to protect confidential information.
- In the event of any dispute between us, as an alternative to any right you may have to take legal proceedings, you may choose to submit the dispute either to the arbitration of two parties (one selected by you and one selected by us) or to a mutually agreed umpire in accordance with the Arbitration Act 1996 or any subsequent amendment to that law.
- You agree without reservation that we may provide information about your use of our services to the Office of the Information Commissioner, the Office of Fair Trading, the Police and to our suppliers. We may also be required to reveal information about you or credit files under compulsion of law, Court Order or by agreement of you and us.
Complaint?
If you wish to make a complaint, please email us. Our complaints policy is that:
- We will acknowledge your complaint usually within 24 hours and always within 2 working days.
- We will deal with it confidentially.
- We aim to provide a fair response within 5 working days.
- If your complaint requires detailed investigation we will keep you advised regularly by email of the progress we have made.
- If you are unhappy with our response, you can appeal to our Joint Managing Directors for a personal review of your complaint, by writing to us at Credit Reporting Agency Limited, Chynoweth House, Trevissome Park, Truro, Cornwall, TR4 8UN
- If your complaint is still not resolved after following the above steps, you are entitled to refer it to the Financial Ombudsman Service.
